Americans with Disabilities Act (ADA) 

Titles II and III of the Americans with Disabilities Act of 1990 provide that no entity shall discriminate against an individual with a disability in connection with the provision of transportation service.  The law sets forth specific requirements for vehicle and facility accessibility and the provision of service, including complementary paratransit service. 

 

ADA Paratransit

ADA Complementary Paratransit certification is done by Access San Joaquin. Passengers receive an in-person functional assessment. Once ADA-certified, you will have ridership privileges within each jurisdiction in San Joaquin County based on that agency's ADA fare structure.

Reasonable Modification Accommodation

In compliance with Department of Transportation (DOT) 49 (CFR) Parts 27 and 37, the City of Manteca is committed to ensuring equal access for all individuals to use its transportation services, including Manteca Transit Fixed Route, Dial‐A‐Ride and ADA Paratransit service. The City will make reasonable accommodations / modifications to its policies, practices, and procedures when necessary for individuals with disabilities to receive access to these services.

Making Requests for Reasonable Accommodations for People with Disabilities:  

When submitting a request for reasonable accommodation, please describe as specifically as possible what you need in order to use the service and make your request in advance whenever feasible. In instances where it is not feasible to make a request in advance, our operating personnel shall make a determination of whether the modification should be provided at the time of the request.  

 

Denials of Requests for Reasonable Accommodation:  

Requests for accommodation and modification of the City’s transportation system policies and practices may be denied only on one or more of the following grounds:  

  1. Granting the request would fundamentally alter the nature of the City’s transportation services, programs or activities.

  2. Granting the request would create a direct threat to the health or safety of others.

  3. The request is not necessary in order for the individual to fully access the transportation services, programs or activities.  

 

In any instance in which a request is denied, the City will take, to the maximum extent possible, any other actions (that would not result in a direct threat or fundamental alteration) to ensure that the individual with a disability receives full access to transportation services.  

 

 Reasonable Accommodation/Modification Appeals

If you disagree with the Manteca Transit’s response to your request for reasonable accommodation/modification or alleging an action prohibited by the Americans with Disabilities Act (ADA) regulation found at 49 CFR Part 27, 37, 38, and 39, you may file an appeal. Please read the following directions.

Complete the Request for Appeal Form within 21 days of the date of the response to your initial complaint.  If you do not request an appeal by this date, you forfeit your right to appeal the decision.  Mail or email the appeal form to

All appeals must be submitted in writing. If you are unable to write because of a disability and need assistance in completing the form, Manteca Transit staff will assist by scribing your appeal request by phone. Please contact Manteca Transit 209.456.8775.

You will be notified of the date and time when your hearing is scheduled. If you need a language or sign language interpreter, request one at least seven days in advance of the hearing.

We encourage you to attend the hearing. If you are not available at the time specified but want to attend, please let us know immediately. If you choose, you may send a representative to meet with the Reasonable Accommodation/Modification Appeals Panel, or you may submit information in writing that you’d like the Panel to consider. If you, or your representative, do not attend, after agreeing with the appointment, the Reasonable Accommodation/Modification Appeals Panel will make a decision based on all the information available at the time of the hearing.

The Reasonable Accommodation/Modification Appeals Panel includes an Manteca Transit Accessible Services Representative, a member of the Manteca Transit Accessibility Advisory Committee and an Manteca Transit Customer Relations Representative. This Panel will make a decision on your appeal within 30 days of your hearing and you will be notified in writing of the decision.

The appeal date and time will be established based on the availability of The Reasonable Accommodation/Modification Appeals Panel and within calendar 21 days of the date of the appeals request.

The decision of the Reasonable Accommodation/Modification Appeals Panel Appeals Panel is final.
